Agreed that H-1B has a fixed date. But from the employer standpoint, you're their "full-time, permanent" employee on H-1B, right? Because Future GC job could be same job on H-1B, only difference being on H-1B your job has fixed end date (noted by I-94), and GC job has no fixed end date, hence permanent. It does not make that current job on H-1B permanent.
Temp Job and Permannet Job can have same job title and job duties. Just like contract job and full-time job can have same job title and job duties, but one is employee of the company and other one is not.

Gurus,
I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.
I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003
Please help.

Sorry to hear about your diagnosis and our prayers are with you and your family.
But as suggested by IV members, please do consider a visit to india and take second opinion from the Tata Memorial Hospital in Mumbai, its one of the best cancer treament centre in the world.
US Healthcare system is for Profit, some medical facilities in US are exception, but if you see the overall Healthcare system it sucks and its all driven by insurance and big Pharmaceutical companies.
Please send me the private e-mail if you need any help in Mumbai to reach good doctor in Tata Memorial Hospital.

Regarding my family, something is working out in Sweden and probably all of us will move there permanently in 1-2 months. We have some relatives living there.

I have PD of Dec 2005 and I140 approved in June 2006 from TSC. Filed 485 on July 3rd .checks not cashed yet neither received the Receipt notice. Called up and lady checked the system and my 485 app is not in the system. She told me to call around 20th to check the status. What are they cooking ? I am not sure.

Yes, case was originally filed at NSC on July 2nd and on august 24th it got transferred to TSC.
Does the transfer matter here, because dingudi's case is not a transfer case and he's still waiting...
I am in the same boat. 485 filed at NSC on July 12, sent to TSC on September 7th. EAD/AP filed on Aug 9 at NSC and they are still in NSC.
I have AP approved and EAD pending. No FP notice yet either. Its been more than 45 days since opening a SR for that for both me and my wife. System sucks. I have been to the local ASC 3 times with no results.
Again I am not sure if the fact that my 485 is in TX and EAD/AP is in NE is cauing all the problems.

Guys until CIR passes soft country limits Remain right? ALso a lot of us who have applied on Eb3 DO have Masters in the US, it's just that our lawyers played it safe and applied in EB3.
Please correct me if i am wrong.
Say the SKIL bill goes thru quicker and much b4 the CIR. Then it is beneficial to all of us right? The Eb1s, Eb2s and Eb3's with a US advanced degrees are exempt from the cap and the eb1 overflow will still go to eb2 and eb2 overflow will go to eb3. That way everyone benefits to some degree.

The CIR has been scheduled for debate starting May 15th (unconfirmed report made available to us). The SKIL bill has not been scheduled.
As far as passing the SKIL bill goes, it is in the same boat as the TALENT and PACE. They still need to be scheduled in spite of the PACE bill having 60 co-sponsors. Remember that the McCain Kennedy bill and Cornyn Kyl bill were proposed almost a year before they got considered.
So just want to temper everyone's expectations here. I don't think the SKIL bill will pass before the CIR. If the CIR fails, only then will the SKIL/PACE/TALENT bills gather some momentum.

Another silent deshi employer here trying to scar H1s not to sue. I guess he created his ID (Join Date: Apr 2008) just for this.
Go and create another website in favour of deshi blood su&^%$rs called reverse-IV.org. Don't try to mock here.
i agree with u gc4me. he seems to be one among my employer's company. if u see, he has replied only for this post, nothing other than this post. except this issue, he doesn't seem to be interested in any other issues in this forum..earlier he said his friend paid $350 for evaluation of non compete and now he says he himself paid $350 to attorney. how can anyone be 9 yrs on

Why did you come here instead of home country ... i came here to do the landing, and thought i'll do the visa stamping as well + Regular employer/ job /education questions ...come back tomorrow to collect the passport

Don't raise hope to much. Get a back up plan which you can be happy with. If you really like to be in the US and dislike going back, consider the asylum option, which could be very fast.

No one can force you to work for them. If there is no breakage clause, then the agreement will not stand in court. Issue is when there is a breakage clause. If there is a breakage clause, you may either have to fight it or suck it up and pay the amount (as long as it is a basis for the amount - just saying "pay $10K if you leave the job" will not stand in court either).
Usual disclaimer is - this is not legal advice. Consult a lawyer for good legal advice.
